Conditions.
This document governs the use of conectalab.co. Projects, proposals and professional services contracted with Conecta Lab are also governed by their own contracts, service orders or commercial agreements.
Acceptance and scope
These Terms and Conditions govern access to, browsing and use of the website conectalab.co (the “Site”). By accessing or using the Site, the user confirms that they have read, understood and accepted these terms. If you do not agree, you must refrain from using the Site.
The Site is aimed mainly at individuals, companies and organizations interested in digital transformation, product design, software development, data, automation, the Internet of Things and related services.
Site operator
The Site is operated by Conecta Lab Corp., doing business as “Conecta Lab”, with operations in Panama and Colombia. For matters related to the Site, you may write to info@conectalab.co or call +507 6252 2816.
References to “Conecta Lab”, “we” or “our” in this document refer to Conecta Lab Corp.
Purpose and nature of the content
The Site’s content provides general information about our company, capabilities, approach, products, partners and contact channels. It is published for general informational and commercial purposes.
Descriptions of products and platforms are informational. The availability of features, and any items marked “coming soon” or presented as roadmap items, are not a commitment to deliver or to meet any date. We do not guarantee savings percentages or performance results: any figure or example is illustrative and depends on each client’s circumstances.
No text, case study, figure, image, demonstration, methodology or description constitutes, by itself, an irrevocable offer, a guarantee of results, or legal, financial or technical advice applicable to a specific case. The scope, price, schedule, deliverables, service levels, intellectual property and responsibilities of each project must be set out in writing in a separate contractual document.
Permitted use of the Site
Users may browse, consult and share links to the Site’s content for lawful purposes. Users may not:
- Access, or attempt to access, systems, accounts, servers or restricted areas without authorization.
- Introduce malware, harmful code, abusive automation or mechanisms that affect the availability of the Site.
- Carry out bulk extraction of content, abusive scraping or systematic reproduction without prior authorization.
- Impersonate others, provide false information or use the contact channels for fraud, spam or unlawful activities.
- Copy, modify or commercially exploit protected elements of the Site except with express authorization or under an applicable legal exception.
- Use the Site in a way that infringes the rights of third parties or violates intellectual property, privacy or data protection rules.
We allow the Site to be indexed and crawled by search engines and AI assistants in accordance with our robots.txt file. We ask that automated access be proportionate and not abusive. Quoting our content with attribution and a link to conectalab.co is welcome.
Intellectual property
Unless otherwise indicated, the design, structure, text, code, interfaces, animations, trademarks, trade names, methodologies and other original elements of the Site belong to Conecta Lab or are used with authorization.
Credited editorial photographs remain subject to the rights and licenses of their respective authors or source platforms. Trademarks, logos and content of partners, clients or third-party products belong to their owners.
Access to the Site does not transfer any license or intellectual property right, other than the limited, personal, revocable and non-exclusive permission needed to browse it.
Requests, proposals and engagement
Submitting an inquiry or requesting a proposal does not oblige Conecta Lab to accept a project, nor does it automatically create a contractual, employment, partnership, fiduciary, agency or exclusivity relationship.
An engagement exists only when the parties approve the applicable terms in writing. In the event of a conflict, the contract, accepted proposal, service order, confidentiality agreement or project-specific document prevails over these terms.
Preliminary information sent by an interested person should be limited to what is reasonably necessary. Confidential information, trade secrets, credentials, sensitive data or third-party material must not be sent without authorization and an appropriate confidentiality agreement.
Products, partners and third parties
The Site presents Conecta Lab’s own products (Pulso, iSell and Laurel), each with dedicated pages on this Site. The availability, features and commercial terms of each product are defined in separate proposals, contracts or terms for that product.
The Site may also mention or link to strategic partners, such as IoTiva, Pulpo Brand and Prosso Group, as well as third-party services and platforms, including Instagram, WhatsApp and Google service providers. Each third party operates under its own terms, policies, availability and security practices.
A link or mention does not imply that Conecta Lab controls, guarantees or assumes responsibility for the information, products, services or practices of the external site. Users should review the applicable terms before using it.
Availability and changes
We work to keep the Site available, secure and up to date, but we do not guarantee uninterrupted operation, the complete absence of errors, or compatibility with every device, browser or configuration.
We may modify, suspend, withdraw or reorganize content and features for maintenance, security, technical evolution, business decisions, unforeseeable events, force majeure or a request from an authority, without giving rise to any right to compensation.
Disclaimer of warranties
The Site is provided “as is” and “as available”. To the extent permitted by law, Conecta Lab gives no implied warranties of merchantability, fitness for a particular purpose, absolute accuracy, freedom from errors, or results arising from the use of the information published.
This disclaimer does not affect warranties, rights or liabilities that by law cannot be limited or excluded.
Limitation of liability
To the fullest extent permitted by applicable law, Conecta Lab will not be liable for indirect damages, loss of opportunities, revenue, profits, data or reputation, or for interruptions arising solely from the use of, or inability to use, the Site, from decisions made on the basis of its general content, or from linked external services.
Nothing in these terms excludes liability for willful misconduct, gross negligence, infringement of rights that cannot be waived, or any case in which limitation is prohibited by law.
Privacy and personal data
The processing of personal data related to the Site is described in our Privacy Policy, which forms an integral part of these terms. Users are responsible for ensuring that the data they provide is accurate, relevant and lawfully supplied.
Electronic communications
By contacting Conecta Lab, users agree to receive replies related to their request by email, telephone or another means they indicate. This does not amount to authorization for recurring marketing.
Any additional commercial communications will be subject to consent and to the opt-out or withdrawal mechanisms provided by applicable law.
Minors
The Site and our business services are not directed at minors. We do not knowingly request personal data from children or teenagers. If a legal guardian believes that a minor has provided us with information, they may request its review or deletion by writing to info@conectalab.co.
Breach and protection of the Site
Where we detect use that is contrary to these terms or potentially harmful, we may take reasonable protective measures, such as restricting access, preserving technical evidence, notifying providers or authorities, and pursuing the legal remedies available to us.
Governing law and disputes
These terms will be interpreted primarily in accordance with the laws of the Republic of Panama, without disregarding mandatory rules on consumer protection, privacy, electronic commerce or jurisdiction that apply in Colombia or in the user’s place of residence.
Before starting a formal dispute, the parties will try in good faith to resolve it through direct communication. Specific contracts may define a different governing law, jurisdiction, negotiation, conciliation or arbitration, and these will prevail for the corresponding project.
Changes, term and severability
We may update these terms to reflect legal, technical, operational or commercial changes. The current version is the one published on this page with its update date. Material changes apply going forward from their publication or from the date expressly stated.
If any provision is declared invalid or unenforceable, the remaining provisions remain valid. Failure to exercise a right does not constitute a waiver.
In case of discrepancy between language versions, the Spanish version prevails.
